Listings in JerseyLines will be published until JMS is advised the stock are no longer available or are no longer required, or JMS removes the listing as it sees fit. Commission on cattle sales is 7% and on semen sales and embryos is 15%. The purchaser of semen to pay despatch costs.
Jersey Marketing Service Ltd (JMS) accepts listings for publication in JerseyLines and posting on the Jersey New Zealand website, in reliance on the following Terms & Conditions:-
The Lister warrants and undertakes to JMS that there is no material, statement, representation or information contained in the listing that;
- is likely to be misleading or deceptive or otherwise infringe the Fair Trading Act 1986 or any Act passed in substitution thereof;
- or is in full or part defamatory, in breach of copyright, trademark or other intellectual or industrial property right;
- or is otherwise in breach of any provision of any statute regulation or rule of law.
The Lister agrees and acknowledges that JMS is not liable for any consequential damages or losses arising from any cause including but not limited to, any omission or negligence on behalf of JMS.
In consideration of JMS accepting a list for publication the Lister hereby agrees to indemnify JMS against all and any losses, costs, demand, claims, damages, expenses, proceedings and legal costs arising directly or indirectly out of:
- a breach of the terms of clause 1 above:
- JMS having to correct, alter, amend or otherwise change any listing for reason where such correction, alteration, amendment or change has been carried out with reasonable care and skill;
- or any delay in publication or cancellation of the list arising out of any act or omission of the Lister or any act or omission of JMS in exercising its right to correct, alter, amend or change any advertisement.
JMS may refuse to publish or may reject or withdraw any listing from publication without any reason being given to the Lister.
The Lister hereby undertakes to advise JMS immediately of any error appearing in any listing placed by that Lister on the first day after publication.
JMS has sole discretion as to the time of and frequency of publishing JerseyLines and is under no obligation to publish future JerseyLines.
All listings created or set or published by JMS remains the property of JMS
